MINUTES for January 8, 2009 @ 7:15 P.M.

CALL TO ORDER Thomas Stansfield (Chairman), Martin Bothroyd, Lorraine Lucas, Rick Wadhams, Martin Connor, AICP Town Planner/Wetlands Enforcement Officer. Excused Allen Kinsella , Anthony Savarese, Ray Turri
- PUBLIC HEARING: None
- SHOW CAUSE HEARING
- Cease and Desist Order – Inland Wetlands Violation, Gordon Geiger, 58 Tyler Lake Heights, barn addition & right of way improvements, no permits. Mr. Geiger was present to discuss plans with the Commission. Mr. Geiger was asked to fill out an after the fact application and come to last month’s meeting. Mr. Geiger did not come to last month’s meeting. The Commission stated at a previous meeting that Mr. Geiger would not have to have a soil scientist report if he came in with an after the fact application for all work done and any proposed work. If Mr. Geiger disputes any wetlands on his property a soils scientist report must be submitted. Commission stated that Mr. Geiger will have to supply a better sketch, larger scale and more details, of all work proposed and for future
work. A Sequence of events for construction of the wall must be submitted to make the application complete. In addition, if Mr. Geiger plans to repair the culvert on the Right of Way he will have to supply permission from all parties involved with the Right of Way. If Mr. Geiger plans to remove a shed he claims is on his property, but built by a neighbor, Mr. Geiger will need to submit a site plan with a survey showing where all property lines and buildings are. The Commission will accept the submitted application at this meeting, but Mr. Geiger must appear at the next meeting February 5, 2009 with the information requested. He will stop at the office and pay the outstanding fees.
- READING OF THE MINUTES: The Commission members received a copy of the minutes for review.
IN A MOTION made by Mr. Bothroyd seconded by Mr. Wadhams it was voted to approve the December 4, 2008 Regular Meeting Minutes. Vote Unanimous.
- Torrington Country Club, 250 Torrington Road, Excavation and pond dredging in a regulated area. Ed Goodhouse, Golf Course Superintendent, was present to discuss plans with the Commission. In the past and currently the Torrington Country Club has received diversion permits from DEP to irrigate the Golf Course by Ivy Mountain Brook. Their existing permit will expire in 2010 and the DEP has suggested they look for an alternate source of water because they are having a negative impact on the fish population. Mr. Goodhouse submitted details on where the materials will be deposited as requested by the Commission last month. Mr. Goodhouse is still waiting for a sequence of events and S&E plan from his engineer. Mr. Connor stated that DEP Dam Safety Unit will not have jurisdiction over this work. This item is
TABLED until next month.
- David and Tricia Poirer, 107 Sherbrook Drive, excavate drainage ditch. Mr. Poirer was present to discuss plans with the Commission. The existing footing drain has been cleaned out, but now there is no place for he water to go. The applicant would like to dig a path so the water can flow to the swale by the road. The applicant would also like to put in a curtain drain and outlet. The Commission reviewed the plans
IN A MOTION made by Mr. Stansfield seconded by Mr. Bothroyd it was voted to APPROVE the application for David and Tricia Poirer, 107 Sherbrook Drive, Excavate drainage ditch. Vote Unanimous.
- Paul and Susan Jagger, 19 Bexley Court, Construct addition. Ms. Jagger was present to discuss an addition to her house. The addition will be on wood post and concrete piers. Also proposed is a new deck and landscaping including steps. The plans show all work being proposed and S&E controls. The area is currently lawn area in their backyard therefore it is already a disturbed area. They plan on keeping the Wetland area natural.
IN A MOTION made by Mr. Stansfield, seconded by Ms. Lucas it was voted to ACCEPT the application for Paul and Susan Jagger, 19 Bexley Court, Construct addition. Vote Unanimous
- INLAND WETLAND’S OFFICER REPORT – The Commission received and reviewed the Inland Wetland’s Officer Report.
IN A MOTION made by Mr. Wadhams seconded by Mr. Bothroyd it was voted to accept the Inland wetlands Officer report. Vote Unanimous.
- CORRESPONDENCE – Letter dated 12/22/08 Northeast Utilities, Letter dated 12/15/08 from Pamela Miller, Land Use Seminar Brochure, CFL Newsletter, CT Wildlife Magazine
The Commission received the proposed budget
IN A MOTION made by Mr. Stansfield seconded by Mr. Bothroyd it was voted to approve the FY 09-10 budget as submitted by Mr. Connor. Vote Unanimous
Mr. Connor stated that Rista Holda has completed all her DEP classes which enable her to become an Inland Wetlands Agent also she has completed all of her CAZEO classes and is now a Certified Zoning Technician.
The Commission would like Mr. Connor to recommend to the First Selectman that Rista Holda become the Assistant Inland Wetlands Enforcement Officer for coverage during time Mr. Connor is unavailable.
IN A MOTION made by Mr. Wadhams it was voted to adjourn the meeting at 8:32 PM
