Inland Wetlands Commission
MINUTES for February 5, 2009 @ 7:15 P.M.
Town Hall Conference Room, 42 North Street

CALL TO ORDER Thomas Stansfield (Chairman), Martin Bothroyd, Lorraine Lucas, Rick Wadhams, Ray Turri  and Martin Connor, AICP Town Planner/Wetlands Enforcement Officer.  Excused Allen Kinsella and Anthony Savarese.

  • CALL TO ORDER
  • PUBLIC HEARING
  • Proposed amendments to Inland Wetlands Regulations, add new Sections 7.11, 10.8 & 10.9 to bring Regulations into conformance with Public Act 05-124.  Chairman Stansfield opened the public hearing at 7:16 pm.  Mr. Connor explained the proposed amendment which is in response to PA 05-124 that requires notice to a holder of a conservation easement or preservation easement by an applicant prior to submitting an application to the Inland Wetlands Commission.  No questions were raised by the Commission or public.  Motion by Mr. Turri, 2nd by Mr. Wadhams to close the public hearing at 7:20 p.m.

  • READING OF THE MINUTES
Motion by Mr. Bothroyd, 2nd by Mrs. Lucas to accept the minutes as submitted.  Motion carried unanimously.

Mr. Turri recused himself from hearing the next application as he is a member of the Torrington Country Club.  

  • OLD BUSINESS    
  • Torrington Country Club, 250 Torrington Road, Excavation and pond dredging in a regulated area.  Ed Goodhouse, Torrington Country Club was present.  The Commission reviewed plans titled, “Irrigation Pond Project Torrington Country Club, Goshen, Connecticut,” prepared by Leggette, Brashears & Graham, dated 1/29/09 sheets SE-1 – SE-3.  Motion by Mr. Bothroyd, 2nd by Mrs. Lucas to approve the application and grant the permit based on plans submitted.  Motion carried unanimously.
Mr. Turri was reseated at 7:30 p.m.

  • Proposed amendments to Inland Wetlands Regulations, add new Sections 7.11, 10.8 & 10.9 to bring Regulations into conformance with Public Act 05-124.  Motion Mr. Stansfield, 2nd Mr. Wadhams to approve the proposed amendments to the Regulations.  The effective date will be the day after the date of publication.  Motion carried unanimously.
  • Gordon Geiger, 58 Tyler Lake Heights, barn addition & right of way improvements, no permits.  Mr. Geiger was present for his after-the-fact application and to review his sketch plan with the Commission for deposition of the rocks and stumps removed from the regulated area.  He will be removing the stumps off-site and will use the rocks to build a rockwall outside of the regulated area on his property.  The after-the-fact application fee and fee for the show cause hearing has been previously submitted.  Motion Mr. Wadhams, 2nd Mr. Turri to approve the application and grant the permit. Motion carried unanimously.
  • Paul & Susan Jagger, 19 Bexley Court, Construct addition.  Mrs. Jagger was present to review her application and plans with the Commission.  Motion Mr. Bothroyd, 2nd Mr. Turri to approve the application and grant the permit. Motion carried unanimously.
  • NEW BUSINESS
  • 6645 Village Market Place , LLC, 59 Torrington Road, construct addition to Goshen Hardware and add two apartments.  The project Engineer, Ron George, P.E., CCA, LLC, was present on behalf of the applicant.  He reviewed plans titled, “Existing Conditions prepared for 6645 Village Market Place, LLC, Conn. Route #4 – (Torrington Road), Goshen, Connecticut,” by CCA, LLC, dated 10/17/08, sheet E1, “Site Plan” Sheet s-1 and “Compilation Plan,” sheet 1. Torrington Area Health District approval has been granted for the project.  A reserve septic system area off-site on an adjoining property owned by the applicant has been identified should it be required sometime in the future.  This septic system would require additional Inland Wetlands Commission approvals.  Besides the addition to the hardware store, an existing greenhouse will be relocated and new parking area created. No work is proposed within the regulated area.  Motion to accept the application by Mr. Turri, 2nd by Mr. Bothroyd. Motion carried unanimously.
  • INLAND WETLAND’S OFFICER REPORT
Motion Mr. Turri, 2nd by Mr. Bothroyd to accept the Inland Wetland Officer’s report.  Motion carried unanimously.

  • CORRESPONDENCE
  • A written request from Mary Lavoie and Michael McKeeman dated 2/2/09 to extend Inland Wetlands Permit # 11-03-04 for an addition 5 years, to construct a dwelling at lot 329, East Hyerdale Drive, in accordance with plans titled, “Proposed Improvement Location Survey Prepared for Michael McKeeman & Mary Lavoie, Lot 329, East Hyerdale Drive, Goshen, CT,” by CCA, LLC, Sheet 1 of 1, dated 10/2/03 and “Sedimentation and Erosion Control Plan” sheet 1 of 1.  Motion by Mr. Stansfield, 2nd by Mr. Turri to extend the permit to February 5, 2014.  Motion carried unanimously.
The Fall 2008 publication Volume 20 Number 4 of “The Habitat” was passed out to the Commission.
Mr. Connor’s written response on behalf of the Commission dated 1/15/09 to Mrs. Pamela Miller’s letter regarding the impact on wildlife in connection with the proposed Optiwind wind turbine was reviewed.
E-mail correspondence between Mr. Connor and Jim Mersfelder, President, W.L.P.O.A., regarding proposed regulated activities to eradicate milfoil in Woodridge Lake was reviewed.
Upcoming CAWS Meeting 2/26/09 on Stormwater and Wetland Management: An Update on Programs and Practices.
  • Memo to the 1st Selectman date 2/3/09 from Mr. Connor recommending appointment of Rista Holda as Assistant Zoning and Wetlands Enforcement Officer in addition to her duties as Land Use Secretary.
DEP Correspondence to William Houle, W.L.P.O.A. dated 1/8/09 regarding maintenance repairs to the Woodridge Lake Dam.
DEP correspondence for upcoming Municipal Inland Wetlands Staff Only Forum 2/25/09 in Newington.  Mr. Connor was urged to attend.
