REGULAR Meeting Minutes for November 6, 2008 @ 7:15 P.M.

- CALL TO ORDER Present Martin Bothroyd, Allen Kinsella, Lorraine Lucas, Ray Turri, Martin Connor, AICP. Excused: Thomas Stansfield, Anthony Savarese Absent: Antonio Damiani
- PUBLIC HEARING: None
- READING OF THE MINUTES: The Commission members received and reviewed the October 2, 2008 meeting minutes.
IN A MOTION made by Mr. Kinsella seconded by Ms. Lucas it was voted to approved the meeting minutes of October 2, 2008. Mr. Turri Abstains. Vote Carries.
- OLD BUSINESS none.
- NEW BUSINESS:
- Inland Wetland Violation, Gordon Geiger, 58 Tyler Lake Heights, barn addition & right of way improvements, no permits. Mr. Geiger was present to discuss with the Commission. Mr. Connor stated that he had informed Mr. Geiger that he was performing regulated activities within the upland review area and that he needed to stop work. He then received calls that Mr. Geiger had started work again, after inspection, Mr. Connor sent another letter informing Mr. Geiger that he needed to hire a soil scientist, obtain a soils report, come before the Commission and submit an After-the-Fact application.
Mr. Geiger stated that he was unaware that he was working in the wetlands when Mr. Connor had originally told him to stop. After he became aware of that fact he did stop doing work. He had a piece of equipment on his property while he was working on his barn. Before he had to return the machine he wanted to smooth out the area, remove a few rocks & stumps so that he can stabilize and plant grass. The area is now seeded and hayed. He will need to come in with a dump truck or other small piece of equipment to remove the stumps and he is planning on making a wall out of the rocks he removed. He hasn’t hired a soil scientist yet for lack of money.
Mr. Connor stated that there is definitely an intermittent stream there, but unsure of any other associated wetlands and that is why he suggested a soil scientist report.
The Commission instructed Mr. Geiger to submit an After-The Fact application, by the next regularly scheduled meeting, to include all work already done and also include the plan for rocks and removal of stumps. At this point the Commission feels a soil scientist report is not needed for the application, but a detailed sketch with dimensions will be required. Mr. Geiger told the Commission to come by anytime to look at the work that has been done.
- INLAND WETLAND’S OFFICER REPORT: The Commission received and reviewed the Inland Wetland’s Officer Report.
Mr. Turri lives nearby Mr. Londel, 19 West Hyerdale and has concerns related to the Town’s road drainage nearby that precipitated the problems mentioned in Mr. Connor’s report. Based upon Mr. Turri’s comments the Commission would like Mr. Connor to keep Douglas Londell on his enforcement report and continue to monitor sediment and erosion controls.
IN A MOTION made by Mr. Bothroyd seconded by Mr. Turri it was voted to approve the Inland Wetland’s Officer Report. Vote Unanimous.
