Inland Wetlands Commission
SPECIAL Meeting MINUTES for January 10, 2008 @ 7:15 P.M.
Town Hall Fiscal Office, 42 North Street
 

1.       CALL TO ORDER: Thomas Stansfield (Chairman), Martin Bothroyd, Allen Kinsella, Antonio Damiani, Lorraine Lucas, Martin Connor, AICP (Wetlands Enforcement Officer)
Excused: Anthony Savarese and Ray Turri

2  .    PUBLIC HEARING: None

3  .    READING OF THE MINUTES: The December 6, 2007 Meeting minutes were mailed to the Commission prior to the meeting for review
 
IN A MOTION made by Mr. Bothroyd seconded by Mr. Kinsella it was voted to approve the minutes of December 6, 2007
 
4.       OLD BUSINESS:

IN A MOTION made by Mr. Stansfield  seconded by Mr. Kinsella it was voted to Move Item d. ATA Realty Inc./Country Club of Connecticut, LLC lot 74, 167 West Hyerdale Drive, Shoreline Stabilization, landscape wall and patio, grading with in the upland review area to item a.  Vote unanimous

Dennis McMorrow P.E., Berkshire Engineering and Surveying, was present to discuss revised plans with the Commission.  Mr. McMorrow submitted a Landscaping Plan prepared by Kim Barberi.  The yard is currently some grass and some light woods and wetlands along the edge of the property.  The trees that have been marked to be taken down are either unhealthy or in the construction zone.  The Plantings that will replace them will be Mountain Laurel, Cranberry and Blueberry trees.  The Grading on the Site Plan was revised to be less fill behind the proposed wall.  The wall will serve as shoreline stabilization and the slope will feather down behind it. 

Mr. Connor suggests that a Landscape estimate be submitted and a bond taken before any work begins.  They Plan to start work in March

IN A MOTION made by Mr. Stansfield, seconded by Mr. Damiani it was voted to approve the application for ATA Realty Inc./Country Club of Connecticut, LLC lot 74, 167 West Hyerdale Drive, House Construction , Shoreline Stabilization, landscaping, wall and patio, grading with in the upland review area with the condition that The plantings shall be done in accordance with the Planting Plan prepared by Environmental Consultant, Kim Barberi dated 12/24/07.  A cost estimate for implementing the landscape plan given by landscaper, shall be submitted to the Wetlands Enforcement Officer for his review and approval.  A cash bond for implementing the plan shall be submitted prior to the start of any work.  Vote unanimous
 
b.      Colby Engineering & Consulting LLC for Steve Cheek, Rte 63 North Street, Assessor’s Map # 6-10 Lot 42, Wetlands Crossing with driveway access to house. 

Mr. Connor stated that Torrington Area Health District approval has been received and that the applicant would still be required to get CL&P’s Permission to cross their right of way for the septic.

Mr. Connor also stated that it appears that the proposed plans are the only alternative for this lot

Ms. Lucas referred to Ms. Sharp’s presentation and feels that a three year monitoring period for invasive species should be required.  Mr. Stansfield stated that three years is a reasonable period of time because it may take two or three years for an invasive species to show depending on the growing season and to monitor removal process.

IN A MOTION made by Mr. Kinsella seconded by Mr. Damiani it was voted to approve the application WHEREAS, Colby Engineering & Consulting, LLC, applicant on behalf of Steven R. Cheek, 24.71 acre parcel, North Street, (Route 63), Tax Assessor’s Map 6-10 lot 42 has made application for regulated activities with in 75 feet of wetlands or within 75 feet of a watercourse, including as follows:

Filling of inland wetlands for construction of a driveway, septic line and utility connections is proposed.  A single family dwelling with associated grading is to be constructed within the regulated inland wetlands area.
 
WHEREAS, the Inland Wetlands and Watercourse Agency of the Town of Goshen convened and completed a public hearing on this application;

WHEREAS, the professional advisors to the Agency have reviewed said application and provided written and verbal reports to the Commission on this application;

WHEREAS, the Inland Wetlands and Watercourse Agency of the Town of Goshen has determined that a public hearing regarding such application was required per Section 9.1 as the proposed activity constituted a significant activity per Section 2.1aa of the Inland Wetlands and Watercourse Regulations of Town of Goshen, the Agency has evaluated the regulations in carrying out the purposes and policies of Section 22(a)-26 through 22(a)-45 of the CT General Statutes, including matters relating to regulating, licensing and enforcing the provisions whereof, the Agency has taken into consideration all relevant facts and circumstances.  The Agency has determined a feasible and prudent alternative does not exist

NOW THEREFOURE BE IT RESOLVED by the Inland Wetlands and Watercourse Agency of the Town of Goshen as follows:

The aforementioned application with regulated activities, North Street, (Route 63), Tax Assessor’s Map 6-10 lot 42 is approved with conditions as hereinafter specified:

1.      The Wetlands area to the north and east of the proposed driveway and dwelling shown on the above site plan be marked as a “Conservation Restriction Area” and shall be placed under a conservation restriction to preserve in perpetuity and to preclude future wetlands encroachments.  The applicant’s attorney shall prepare a draft conservation restriction for the Inland Wetlands Officer and Town Attorney’s review and approval.  A copy of the executed conservation restriction shall be filed on the land records prior to the start of any construction activities.  A recording Mylar map shall be filed on the land records documenting the conservation restriction area.  A paper copy of the map shall be submitted to the Inland Wetlands Officer for the record file.  The conservation restriction area shall be marked in a manner acceptable to the Inland Wetland Officer prior to any construction

2.      As a further mitigation measure, the shoulders of the proposed driveway shall be planted with native shrubs species in order to form a transition area between the wetlands and the driveway.  The plantings shall be done in accordance with the Planting Plan prepared by Environmental Consultant, Penelope C. Sharp dated 11/1/07, including a 3 year monitoring period for invasive species done by a qualified individual.  A cost estimate for implementing the landscape plan, shall be submitted to the Wetlands Enforcement Officer for his review and approval.  A cash bond for implementing the plan shall be submitted prior to a zoning permit being issued for construction of the dwelling.

3.      During construction of the driveway the Wetlands Enforcement Officer will review on site whether a 4th culvert in addition to the 3 culverts shown on the plan is advisable to further defuse the water and will direct the contractor to add the 4th culvert if needed.

4.      Orange construction fencing shall be placed behind  the silt fencing to further demark the area of disturbance

c.       Vincent and Rachael D’Andrea, 19 Park Road, Install new septic system within regulated area.  – Tabled until February 7, 2008

d.      James L. Mersfelder and Sandra L. Stark, 11 Woodale Court, rock removal

The applicant was not present, Mr. Connor stated that the rocks are showing during the draw down and the applicant plans on smashing or blasting the rocks because they cause a swimming and boating danger.  Permission from the Woodridge Lake Property Owners Association has been received.

IN A MOTION made by Mr. Bothroyd seconded by Mr. Stansfield it was voted to approve the application for James Mersfelder and Sandra L. Stark, 11 Woodale Court, rock removal with the condition that work be done when there is sufficient draw down and no equipment goes into the water.  Vote unanimous

5.       NEW BUSINESS: None

6  .    INLAND WETLAND’S OFFICER REPORT:  The Commission received an reviewed the Inland Wetland’s Officer Report
 
IN A MOTION made by Mr. Damiani seconded by Mr. Kinsella it was voted accept the Inland Wetland’s Officer Report
 
7.       CORRESPONDENCE

IN A MOTION made by Mr. Stansfield seconded by Mr. Bothroyd it was voted  to approve the projected budget recommend submittal to the fiscal office.  Vote unanimous
Letter for King’s Mark Resource offering services, Letter from DEP, LHCEO website List, Roles and Responsibilities Workshop on 1/29 – any Commission members who would like to attend can sign up.

8.       ADJOURNMENT
