MINUTES for July 2, 2009 @ 7:15 P.M.

- CALL TO ORDER: Thomas Stansfield (Chairman), Martin Bothroyd (Vice Chairman), Lorraine Lucas, Anthony Savarese, Allen Kinsella, Rick Wadhams, Ray Turri, Martin Connor, AICP, Town Planner/Wetlands Enforcement Officer

- READING OF THE MINUTES: The Commission received the minutes prior to the meeting for review
IN A MOTION made by Mr. Turri seconded by Ms. Lucas it was voted to APPROVE the June 4, 2009 meeting minutes as written. Vote Unanimous
- OLD BUSINESS
a. Alan Bongiovanni for Henry & Judith D Budney, Trustees, 610 North Street, Cease and Desist Order for placing stones/rocks within a watercourse. Mr. Connor stated that he did an inspection and it appears that all work has been restored to its original condition. A letter was read from Mr. Bongiovanni dated 6/4/09, stating that the Budney’s realize they will need to obtain an inland wetlands permit in the future, prior to starting any work within 75 feet of a wetlands or watercourse.
The Commission feels this enforcement action has been addressed and closed this matter.
b. Daniel Kobylenski, 12 Park Rd, Shoreline Stabilization – Mr. Kobylenski was unable to attend the meeting, but all questions were answered at the previous meeting.
IN A MOTION made by Ms. Lucas seconded by Mr. Turri it was voted to APPROVE the application for Daniel Kobylenski, 12 Park Rd, Shoreline Stabilization. Vote Unanimous.
- NEW BUSINESS
- Lawrence K & Eileen Fisher, 231 West Hyerdale Drive, After the Fact Application to remove and rebuild a deck and disturbance to regulated area. Mr. Connor had received complaint from Mr. Turri that work was being done without a permit. After review of the file and inspection, Mr. Connor issued an enforcement letter to Mr. & Mrs. Fisher for regulated activities, for demolishing and rebuilding a deck and site work without a permit. Mr. Connor also noticed that while they were doing the site work, the heavy equipment being used had severely nicked several trees. Mr. Connor has concerns as to whether or not those trees will survive. Mr. Connor also stated that the site work performed is mainly stone and the mulch using dyed wood chips, causing concern over the impact to the water quality on site,
since now there is limited protection for the lake.
Dennis McMorrow, P.E., Berkshire Engineering and Surveying was hired by the applicant after receiving the enforcement letter and was present at the meeting. Mr. McMorrow submitted a site plan of what the current condition of the property is, including the wetlands which have been flagged.
The Commission member do have several concerns regarding the activities which have occurred and have asked that a landscape architect prepare a planting plan which would protect the water quality of the lake. Also, that either a Landscape Architect or an Arborist, which ever is most qualified, determine if the nicked trees are likely to survive or not.
The Commission would also like to know what chemicals and/or materials are used in the wood chips that have been placed.
The Commission understood that the plan submitted was simply showing the current conditions, but instructed Mr. McMorrow to come to the next meeting with plans describing exactly what the applicant would like the final outcome to be, including what materials will be used i.e.: gravel, mulch etc.. .
IN A MOTION made by Mr. Stansfield seconded by Mr. Turri it was voted to ACCEPT the after the fact application for Lawrence K & Eileen Fisher, 231 West Hyerdale Drive, remove and rebuild deck. Vote Unanimous
- Sanford Dubner, 4 Marshepaug Road, construct pool with patio. Dennis McMorrow, P.E., Berkshire Engineering and Surveying, was present on behalf of the Commission. Mr. McMorrow stated that he had examined several different locations for this pool, and feels the proposed location would have the least amount of impact on the wetlands. It would be difficult to locate the pool on this property without a portion of the work being done within the wetlands. Mr. McMorrow stated these wetlands are grassy wetlands and are maintained as a lawn. To limit the grading, a 3 foot stone wall is proposed that will act as a barrier to backfill against. The wall will be installed prior to any pool construction. Mr. McMorrow is aware of drainage concerns expressed by Mr. Connor by the
neighbors and has proposed grading to a swale which leads to a culvert under the driveway so the water won’t drain into the neighbors yard.
Mr. Stansfield stated that he feels this is a functioning wetlands and although the impact is minimal he asked Mr. McMorrow to determine what the loss would mean to the lake and what mitigation could be taken.
IN A MOTION made by Mr. Turri seconded by Ms. Lucas it was voted to ACCEPT the application for Sanford Dubner, 4 Marshepaug Road, construct a pool with patio. Vote Unanimous.
IN A MOTION made by Mr. Stansfield seconded by Mr. Turri it was voted to add to the agenda Torrington Savings Bank and Tywood Associates, 55 Sharon Turnpike, Demolish exiting structure, grade, fill and Construct Building, wall, drainage system and pavement. Vote Unanimous
- Torrington Savings Bank and Tywood Associates, 55 Sharon Turnpike, Demolish exiting structure, grade, fill and Construct Building, wall, drainage system and pavement. Jeff LaLonde, President/CEO of Torrington Savings Bank, along with his engineer, Larry Buck, P.E., and Landscape Architect, Rosemary Aldridge were present to discuss the plans with the Commission. The plans include the construction of a new bank branch location, septic, parking and drainage. The drainage proposed is a Low Impact Development (LID) system, which will allow sheet flow off the parking lot, in two directions into infiltration trenches. There are still some details, such as the type of plantings and materials. Ms. Aldridge and Mr. Buck are working on these plans and will bring final details to the next meeting. Upon Mr. Connor’s recommendation the Commission has requested that Richard Calkins, P.E., Town Engineer, review the plans. The Commission would also like a snow plow plan to ensure the
stockpiling of snow will not interfere with the drainage.
IN A MOTION made by Mr. Savarese seconded by Mr. Turri it was voted to ACCEPT the application for Torrington Savings Bank and Tywood Associates, 55 Sharon Turnpike, Demolish exiting structure, grade, fill and Construct Building, wall, drainage system and pavement. Vote Unanimous.
- INLAND WETLAND’S OFFICER REPORT: The Commission received and review the Inland wetland’s Officer’s Report.
IN A MOTION made by Mr. Stansfield seconded by Mr. Wadhams it was voted to ACCEPT the Inland Wetland’s Officer’s Report. Vote Unanimous.
- CORRESPONDENCE: Habitat, Aquatic Pesticide permit applications on Hiltz Pond, DEP notice of water diversion permit approval for Torrington Country Club.
- ADJOURNMENT
IN A MOTION made by Mr. Savarese it was voted to ADJOURN the meeting at 9:34pm.
