Inland Wetlands Commission

Minutes for October 1, 2009 @ 7:15 P.M.

Town Hall Conference Room, 42 North Street

 

  1. CALL TO ORDER: Thomas Stansfield, Chairman, Lorraine Lucas, Allen Kinsella, Rick Wadhams, Martin Connor, AICP – Excused: Martin Bothroyd -Absent: Ray Turri, Anthony Savarese
 

 

  1. PUBLIC HEARING: None

 

  1. READING OF THE MINUTES: The Commission received and reviewed the September 3, 2009 meeting minutes

 

IN A MOTION made by Mr. Kinsella seconded by Mr. Wadhams it was voted to ACCEPT the September 3, 2009 meeting minutes as written. Vote Unanimous.

 

  1. OLD BUSINESS

a.       Colby Engineering & Consulting LLC for Alan C. Rothfeld & Laura Colangelo, 30 Benjamin Lane, demolish existing cottage and rebuild new dwelling, septic system and well. Mr. Colby was present.  He submitted the Torrington Area Health District Approval and stated that he has also received Zoning Board of Appeals Approval.  The proposal is to combine 2 lots, demolish the existing cottage and rebuild a new cottage.  Also, they plan on installing a code complying well and septic system.  Due to the location of the well and septic the only location on the lot would be the proposed location which would be 27 feet away from Dog Pond, including the deck.  Mr. Colby submitted a letter from Kyle Turoczi, wetlands ecologist, stating that due to the footing drains a rain garden/ bio retention basin should be installed.  The homeowners are committed to installing the rain garden and maintaining it.

 

IN A MOTION made by Ms. Lucas seconded by Mr. Wadhams it was voted to APPROVE the application for Colby Engineering & Consulting LLC for Alan C. Rothfeld & Laura Colangelo, 30 Benjamin Lane, demolish existing cottage and rebuild new dwelling, septic system and well with the condition that a prior to the issuance of a zoning permit, the applicant will submit a plan for the rain garden, acceptable to the wetlands agent.  Vote Unanimous.

 

b.      White Hall Construction, Lot 734 Bexley Court, Single family dwelling and driveway – This item was tabled until later in the meeting.

 

  1. NEW BUSINESS

 

Mr. Wadhams recused himself at 7:25 pm

a.       Mark Harris for Marshapaug Tax Payers Association, Between 92 and 93 Sandy Beach Road, drainage improvements.  Mr. Connor stated that this proposal is maintenance of a storm drainage pipe that is currently eroding Sandy Beach Road.  The proposal will help prevent erosion and sedimentation.  The outlet of this drainage system goes into an intermittent stream therefore making this a regulated activity.

 

IN A MOTION made by Mr. Stansfield seconded by Mr. Kinsella it was voted to ACCEPT the application for Mark Harris for Marshapaug Tax Payers Association, Between 92 and 93 Sandy Beach Road, drainage improvements. Vote Unanimous.

 

Mr. Wadhams returned at 7:29pm

 

b.      Bill Skoczylas for Lynn Wellenkemp, 42 Brynmoor CT, construct garage.  Mr. Skoczylas was present and explained to the Commission that he would like to put a one car garage addition to the side of the house, the proposed location is the furthest away from the wetlands and would not be any closer to the wetlands than the existing house.

 

IN A MOTION made by Mr. Stansfield seconded by Mr. Wadhams it was voted to ACCEPT the application for Bill Skoczylas for Lynn Wellenkemp, 42 Brynmoor CT, construct garage. Vote Unanimous.

 

c.       Naren Sonpal, 187 Westside Road, clean existing farm pond for agricultural use.  Mr. Sonpal has and existing pond, which is currently silted in, which he plans on cleaning.  Mr. Sonpal raises cows on his property and this pond is essential to his agricultural use.

 

IN A MOTION made by Mr. Stansfield seconded by Mr. Kinsella it was voted to DECLARE the activity for Naren Sonpal, 187 Westside Road, clean existing farm pond an agricultural use which is PERMITTED AS OF RIGHT, according to Section 4.1a of the Goshen Inland Wetlands and Watercourse Regulations. Vote unanimous.

 

d.      Sean O'Neill, 50 Gray Lane, construct barn for agricultural purposes.  Mr. O’Neill plans on constructing a barn to house his live stock.  The location proposed is the widest part of his land and he can maintain zoning requirements.  The proposed location is a grassy area which his livestock currently graze.  This barn would be essential to his agricultural use.

 

IN A MOTION made by Mr. Stansfield seconded by Mr. Kinsella it was voted to DECLARE the activity for Sean O'Neill, 50 Gray Lane, construct barn as an agricultural use, PERMITTED AS OF RIGHT, according to Section 4.1a of the Goshen Inland Wetlands and Watercourse Regulations. Vote Unanimous.

 

e.       William Seitz for Henry and Judith Trust, 610 North Street, two temporary wetlands crossings for timber harvest.  Mr. Seitz activities include a timber harvest on the lower part of the property, and there will be no clear cutting.  He will need to construct two temporary bridges to haul the lumber out.  One bridge will be in an area that is wet when it rains only and the other bridge will be crossing the stream in an area where there are existing boulders.  Mr. Seitz will contact Mr. Connor and perform a site walk prior to the next Inland Wetlands Meeting.

 

IN A MOTION made by Mr. Stansfield seconded by Mr. Kinsella it was voted to ACCEPT the application for William Seitz for Henry and Judith Trust, 610 North Street, two temporary wetlands crossings for timber harvest. Vote Unanimous.

 

IN A MOTION made by Mr. Stansfield seconded by Ms. Lucas it was voted to ADD to the Agenda the following applications:  Howard Noreike for. Patrick Sullivan and Patti LeShane, 52 Cottage Grove Road, After the fact shoreline Stabilization and fence; Joe Pedone, 121 West Side Road, Maintain existing irrigation pond, inlet and outlet; Frank & Janis Castiglione, 193 West Hyerdale Drive, replace deck with stone patio and stabilize shoreline; Tom Cornacchia, 496 Hageman Shean Road, garage, driveway, parking area with retaining wall and grading within the regulated area; Thomas Ciavarelli, Lot #605 Corner of Dresden Court and Brynmoor Court, extend permit # 10-01-04; Edward Goodhouse for the Torrington Country Club, 250 Torrington Road, install dry hydrant. Vote Unanimous.

 

 

f.        Howard Noreike for. Patrick Sullivan and Patti LeShane, 52 Cottage Grove Road, After-the-fact shoreline stabilization and fence.  Mr. Noreike was present to discuss the plans with the Commission.  Mr. Noreike has been doing work on the house and did install the fence, but has not done any work on the retaining wall.  The fence has been installed to keep the kids away from the water and it connects both houses.

 

The retaining wall was constructed where there was an outcropping of rocks, which was apparently the old stone wall perimeter.  The wall was rebuilt dry with the top layer cemented.  The Commission has several concerns as to where the wall was built.  According to the survey shown the wall it was not constructed on their property and was constructed during the summer, when the water was high.   The Commission suggested that the homeowners hire someone to determine the exact property line and come to the meeting next month to discuss this with the Commission.  If it is determined that the wall is not on the same property the applicant should prepare plans on how to remove the wall. This application is tabled until next month

 

Mr. Stansfield recused himself at 7:08 pm

g.       Joe Pedone, 121 West Side Road, Maintain existing irrigation pond, inlet and outlet – Mr. Connor received a phone call regarding work being done on this pond.   The work done was maintenance to an irrigation pond which is essential to his nursery.

 

IN A MOTION made by Mr. Kinsella seconded by Mr. Wadhams it was voted  to DECLARE the activity for Joe Pedone, 121 West Side Road, Maintain existing irrigation pond, inlet and outlet an agricultural use which is PERMITTED AS OF RIGHT in accordance with Section 4.1a of the Goshen Inland Wetlands and Watercourse Regulations. Vote Unanimous.

 

Mr. Stansfield returned at 7:11 pm

 

h.       Frank & Janis Castiglione, 193 West Hyerdale Drive, replace deck with stone patio and stabilize shoreline.  The applicants currently have a pre-existing non-conforming deck which needs to be repaired.  Mr. Connor suggested removing the deck, which is currently in the water, and replacing it with a stone patio, which would meet zoning requirements and would be better for the environment.  While doing that work they would also like to stabilize the shoreline with the existing rocks.  The Commission would like to see construction details on how the patio and shoreline stabilization would be done.

 

IN A MOTION made by Mr. Stansfield seconded by Mr. Kinsella it was voted to ACCEPT the application for Frank & Janis Castiglione, 193 West Hyerdale Drive, replace deck with stone patio and stabilize shoreline. Vote Unanimous.

 

The Commission returned to item 4b on the agenda.

4 b. White Hall Construction, Lot 734 Bexley Court, Single family dwelling and driveway.  Dennis McMorrow, P.E., Berkshire Engineering and Surveying  was present to discuss the application with the Commission.   There is only a small area of wetlands on abutting property.  There is no work proposed within the wetlands. 

 

IN A MOTION made by Mr. Stansfield seconded by Ms. Lucas it was voted to APPROVE the application for White Hall Construction, Lot 734 Bexley Court, Single family dwelling and driveway. Vote Unanimous.

 

Mr. Kinsella recused himself at 8:20 pm

i.         Tom Cornacchia, Ivy Mountain Farm, LLC,  496 Hageman Shean Road, garage, driveway, parking area with retaining wall and grading within the regulated area. Dennis McMorrow, P.E., Berkshire Engineering, was present on behalf of the applicant.   This parcel is 613 acres.  There is an existing permit to replace an cabin and septic on the property next to the pond.  They would like to install a retaining wall, garage and parking area down by the new dwelling.  The existing house plan has an extensive landscaping plan for final stabilization of the area.

 

IN A MOTION made by Mr. Stansfield seconded by Ms. Lucas it was voted to ACCEPT the application for Tom Cornacchia, Ivy Mountain Farm, LLC, 496 Hageman Shean Road, garage, driveway, parking area with retaining wall and grading within the regulated area. Vote Unanimous.

 

Mr. Kinsella returned at 8:27 pm

 

j.        Thomas Ciavarelli, Lot #605 Corner of Dresden Court and Brynmoor Court, extend permit # 10-01-04 – There are no proposed changes to activity or existing conditions.

 

IN A MOTION  made by Mr. Stansfield seconded by Mr. Kinsella it was voted to EXTEND permit # 10-01-04 for Lot #605 Corner of Dresden Court and Brynmoor Court for another 5 years, and all original conditions apply. Vote Unanimous.

 

k.      Edward Goodhouse for the Torrington Country Club, 250 Torrington Road, install dry hydrant.  Torrington Country Club would like to install a dry hydrant for fire protection in their pond.  There is already and existing access road, so there will be very limited disturbance.  They have control over the water levels in the pond and will lower the pond during construction.  For next month’s meeting,  Mr. Goodhouse will bring in details of the installation as well as where the fire trucks would park to access the hydrant.

 

IN A MOTION made by Mr. Stansfield seconded by Mr. Wadhams it was voted to ACCEPT the application for Edward Goodhouse for the Torrington Country Club, 250 Torrington Road, install dry hydrant. Vote Unanimous.

 

  1. INLAND WETLAND’S OFFICER REPORT: The Commission received and reviewed the Inland Wetland’s Officer’s Report.

 

IN A MOTION made by Mr. Kinsella seconded by Mr. Stansfield it was voted to accept the Inland Wetland’s Officer’s Report.  Vote Unanimous.

 

  1. CORRESPONDENCE: College of Agriculture and natural resources journal.
  2.  ADJOURNMENT

IN A MOTION made by Mr. Kinsella seconded by Mr. Wadhams it was voted to ADJOURN the meeting at 8:37 pm. Vote Unanimous.
