Minutes for April 1, 2010 @ 7:15 P.M.

1. CALL TO ORDER Thomas Stansfield, Lorraine Lucas, Anthony Savarese, Martin Bothroyd, Allen Kinsella, Rick Wadhams, Martin Connor, AICP – Excused Ray Turi
2. PUBLIC HEARING: None
3. READING OF THE MINUTES– The Commission received and reviewed the March 4, 2010 meeting minutes
IN A MOTION made by Bothroyd seconded by Savarese it was voted to APPROVED the March 4, 2010 meeting minutes. Vote Unanimous
4. OLD BUSINESS - None
5. NEW BUSINESS
a. Discuss Proposed Amendments to the Inland Wetlands Regulations Mr. Connor discussed the proposed regulation change. The Changes would add the definition of Low Impact Development to section 2.1 of the regulations, add Low Impact Development Language to the existing sections 7.5(f), 7.5(i) and 7.6 (g). In addition Language would be added to Section 7 and Section 11 to comply with Public Act 09-181
IN A MOTION made by seconded by it was voted to ACCEPT the Regulation Changes and Set a public hearing for June 3, 2010. Vote Unanimous
IN A MOTION made by seconded by it was voted to ADD TO THE AGENDA the following items:
- Raymond and Cynthia Van Duyne, Lot #235 Canterbury Court, Construct Single Family Dwelling, Driveway, Septic and Well .
- William Hurlburt, Meekertown Road, Declaratory Ruling to Re-grade Road and repair or replace culverts
- Peter Fay, 13 Allyn Road, Declaratory Ruling to Clean out Pond
- Richard Assenza, Transfer Permit # 10-01-04
Vote Unanimous
b. Raymond and Cynthia Van Duyne, Lot #235 Canterbury Court, Construct Single Family Dwelling, Driveway, and Well . This activity was originally permitted but the permit has expired. There are no changes to the original permit. The original permit did require a public hearing. There are reports from experts in the previous record.
IN A MOTION made by Mr. Kinsella seconded by Mr. Wadhams it was voted to ACCEPT the application for Raymond and Cynthia Van Duyne, Lot #235 Canterbury Court, Construct Single Family Dwelling, Driveway, and Well. Vote Unanimous.
c. William Hurlburt, Meekertown Road, Declaratory Ruling to Re-grade Road and repair or replace culverts. Mr. Hurlbut was present to discuss with the Commission. The road currently needs to be repaired and the culverts need to be either replaced or repaired. The road is in joint ownership and he will get permission from other owners of the road prior to performing any work. The Commission stated that this is not permission to do the work, but that no permit would be required to perform these activities.
IN A MOTION made by Mr. Stansfield seconded by Ms. Lucas it was voted to DECLARE AN AS OF RIGHT USE to re-grad road and repair or replace culverts in accordance with section 4.1f of the regulations. Vote Unanimous.
d. Peter Fay, 13 Allyn Road, Declaratory Ruling to Clean out Pond. Mr. Fay was present to discuss with the Commission. He plans on cleaning out the pond and plans on using it to water his livestock. The materials removed from the pond will not be placed in wetlands.
IN A MOTION made by Mr. Wadhams seconded by Ms. Lucas it was voted to DECLARE AN AS OF RIGHT USE to Peter Fay, 13 Allyn Road to Clean out Pond in accordance with Section 4.1a of the regulations. Vote Unanimous
e. Richard Assenza, Transfer Permit # 10-01-04 The Commission reviewed original Permit. The plans will remain the same. The Commission stated that all original permits remain in place.
IN A MOTION made by Mr. Bothroyd Seconded by Mr. Kinsella it was voted to TRANSFER the permit #10-01-04 to Richard Assenza. Vote Unanimous
6. INLAND WETLAND’S OFFICER REPORT The Commission received and reviewed the Inland Wetland’s Officer Report.
IN A MOTION made by Mr. Bothroyd seconded by Mr. Wadhams it was voted to accept the Inland Wetland’s Officer Report. Vote Unanimous.
7. CORRESPONDENCE: CT Wildlife, Ct Audubon Magazine
8. ADJOURNMENT
IN A MOTION made by Mr. Savarese it was voted to ADJOURN at 8:00pm.
