HAWKERS AND PEDDLERS ORDINANCE
Sec. 25-01 Hours Of Solicitation. It shall be unlawful for any person to engage in the vending or hawking upon the public streets of the Town of Goshen of any goods, wares or other merchandises at public or private sale or auction, or in the vending or peddling of such articles from house to house within the limits of said Town except between the hours of 9:00 A.M. and 6:00 P.M. Sec. 25-02 Age Requirement. Every hawker or peddler over the age of sixteen years shall, before engaging in such hawking and peddling, obtain from the Town Clerk of the Town a license to hawk or peddle. (3-31-1964)
Sec. 25-03 Application. The Town Clerk shall issue a license to any hawker or peddler after obtaining the name and home or business address of the applicant, the name and address of his employer, and a physical description of the applicant, including his age, height, weight, color of hair , and eyes, and after receiving a fee of twenty-five dollars. Said license shall be effective for one year from the date of its issue. (3-31-1964)
Sec. 25-04 Definitions. “Hawker” or “Peddler” as used in this ordinance, means any person, whether principal or agent, who goes from Town to Town or from place to place in the same Town selling or bartering; or carrying for sale or barter, or exposing therefore, any goods, wares or merchandise, either on foot or from any animal or vehicle. Sec. 25-05 Exceptions. This ordinance shall not apply to sales by farmers and gardeners of the produce of their farms or gardens, or to the sale, distribution and delivering of milk, teas, coffees, spices, groceries, meats and bakers goods, to sales on approval or to conditional sales of merchandise, or to sales for the benefit of charitable organizations located in or having members resident of the Town of Goshen. Sec. 25-06 Penalty. Any person who engaged in the business of a peddler or hawker without complying with the provisions of this ordinance shall be fined not more than Fifty Dollars.
