TITLE 51
MUNICIPAL SOLID WASTE AND RECYCLING ORDINANCE

BE IT ORDAINED by the legal voters of the Town of Goshen in meeting assembled:

RESOLVED: To rescind the Ordinance entitled Municipal Recycling Ordinance adopted November 19, 1990 and to adopt the following ordinance:

1.      There is hereby established a program for the separate collection and recycling of residential household recyclables generated from all residential properties within the Town of Goshen consisting of (a) all cardboard, glass food containers, metal food containers, newspaper, office paper, scrap metal, storage batteries and waste oil as said terms are defined in §22a-241b-1 of the Regulations of Connecticut State Agencies; (b) all plastic food containers and junk mail as permitted pursuant to C.G.S. § 22a-220(f); and (c) all nickel-cadmium batteries as required pursuant to C.G.S. §22a-256a (together, “Recyclables”).

2.      All Recyclables shall be cleaned, separated from other solid waste and deposited at the curb in containers provided by the Town or its contractors.

3.      All Recyclables placed at the curb in accordance with Section 2 above shall become the property of the Town of Goshen at the time of such placement and it shall be a violation of this ordinance for any person or legal entity other than the Town of Goshen, or its contractors, to collect or pick up any such Recyclables.

4.      Any collector, as said term is defined in C.G.S. §22a-220a(g), hauling or intending to haul solid waste, Recyclables or Non-Residential Recyclables generated by residential business, commercial or other establishments within the Town of Goshen (“Registered Collector”) shall register with the town’s Recycling Official and shall disclose in writing on a form provided by the Recycling Official the name(s) of any other municipalities in which such Registered Collector hauls solid waste.

5.      Only Registered Collectors authorized by the Town of Goshen may collect curbside Recyclables. Recyclables so collected shall be delivered to and processed at such intermediate processing center or regional processing center as may be designated for any particular recyclable item by the Town of Goshen.

6.      All solid waste other than Recyclables and Non-Residential Recyclables generated within the Town of Goshen by residential, business, commercial or other establishments shall be disposed of at the Connecticut Resources Recovery Authority’s Mid-Conn facility or at a transfer station for ultimate disposal at the Connecticut Resources Recovery Authority Mid-Conn facility.

7.      The Town’s First Selectman, or his appointee, is hereby designated as the municipal agent who shall receive information and respond to questions regarding recycling from the Department of Environmental Protection (the “Recycling Official”). The Recycling Official shall also receive from collectors of solid waste and recyclable items, and from operators of resource recovery facilities and solid waste facilities, the notices required to be sent to the Town pursuant to C.G.S. §22a-220c, as the same may from time to time be amended. The Recycling Official shall also implement and coordinate the mandatory municipal recycling program and provide for the disposal of all solid waste generated within the Town of Goshen in accordance with the applicable provisions of the Connecticut General Statutes.

8.      Any Registered Collector who believes or has reason to believe that any person from whom he collects solid waste has discarded Recyclables or Non-Residential Recyclables in violation of C.G.S. §22a-241b, as the same may from time to time be amended, shall promptly notify the Recycling Official of the alleged violation. Upon the request of the Recycling Official, a Registered Collector shall provide a warning notice, by tag or other means, to any person suspected by the Registered Collector or the Recycling Official of violating separation requirements.

9.      All cardboard, glass food containers, metal food containers, plastic food containers, newspapers, office papers, scrap metal, storage batteries and waste oil generated within the Town of Goshen other than from residential property (“Non-Residential Recyclables”) shall be separated from other solid waste for the purpose of recycling.

10.     All Non-Residential Recyclables shall be cleaned, separated from other solid waste and deposited at the curb or other location suitable for collection by a Registered Collector.

11.     All Non-Residential Recyclables shall be delivered by a Registered Collector to such intermediate processing center or regional processing center as may be designated for any particular type of Non-Residential Recyclables by the Town of Goshen.

12.     Each Registered Collector shall submit a report to the Recycling Official setting forth for each type of Non-Residential Recyclables the amount of such type, measured by weight or other method acceptable to the Recycling Official, which originates from the Town of Goshen and is delivered to an intermediate processing center or regional processing center as herein provided. Such report shall be made for the calendar quarter commencing April 1, 2006 and each calendar quarter thereafter and shall be submitted within 30 days of the end of each calendar quarter.

13.     Grass clippings and leaves are prohibited from disposal as solid waste.

14.     In addition to any other civil or criminal remedies available to the Town of Goshen or the State of Connecticut, any collector, as said term is defined in C.G.S. §22a-220a(g), or any other person who violates the provisions of this ordinance and/or the provisions of C.G.S. §22a-220a(f) or 22a-220a(i) shall be liable for a fine payable to the Town of Goshen in an amount not to exceed $1,000.00 for each violation, said fine(s) to be levied and collected in accordance with the provisions of C.G.S. §22a-226d.

This ordinance shall take effect fifteen (15) days after its publication in a newspaper having circulation in the Town of Goshen.
