Zoning Board of Appeals
The primary function of the Zoning Board of Appeals is to hear and determine applications for variances from the zoning regulations. Applications for variances require the applicant to prove that there is an extreme or unusual hardship that prevents them from complying with the regulations. Generally the hardship is connected to the land such as topography, wetlands, or other characteristics that are unique to that individual parcel of land.
Additionally, the Zoning Board of Appeals hears applications to permit the expansion of nonconforming structures by special permit rather than by variance, provided the proposed addition is no closer to the property line than any portion of the existing structure.
The Zoning Board of Appeals also hears appeals of Zoning Enforcement Cease and Desist orders.
